Family trusts

A family trust can be an effective way of protecting the assets which you have worked hard to acquire.  There are many circumstances where a family trust could be useful.  These can include:

•    Protection against creditors
•    To reduce rest home or hospital care costs later in life
•    Tax planning
•    Relationship property claim concerns
•    Family protection claim concerns
•    Protection of assets for the next generation

We provide sound legal advice on whether a family trust is appropriate for your circumstances.  In establishing a trust, we can transfer assets into the trust and attend to all related matters such as updating your will to reflect the change in your circumstances.

Managing a family trust

The role of trustees of a trust is very important.

As a trustee, you look after assets which are not yours even although you established the trust and are a beneficiary of the trust.  As a trustee, you must manage the trust’s assets as a “prudent person” would.  You must also abide by the terms and powers set out in the Trust Deed.

We can assist by providing guidance on what is required to be a diligent and conscientious trustee and help you to ensure that the trust is effectively managed.
