Caroline is a partner in Jackson Russell’s Litigation and Dispute Resolution team.  She has particular expertise in the areas of commercial litigation and property related disputes.

Caroline has broad experience in advising corporate and private clients on a range of disputes.   She is experienced in the areas of commercial litigation and property related disputes, and has expertise in various dispute resolution techniques, including negotiation, mediation and Court litigation.
Caroline also advises businesses, liquidators, and receivers on issues involving security interests, directors’ conduct, the recovery of company payments and debts, and voidable transactions.
Whether the dispute involves litigation or negotiating a resolution, Caroline works with clients to identify their commercial and personal objectives and provides clear advice on the most effective way to resolve the dispute. 
Previous projects have included advising and acting for:
  • A landlord in relation to a damages claim for losses arising from the termination of a commercial lease.
  • A national goods supplier in High Court proceedings involving disputed personal guarantees and security issues under the Personal Property Securities Act.
  • A large residential body corporate in a High Court application for Orders under the Unit Titles Act to resolve issues arising from repairs to the body corporate apartments.
  • A dry stock farming partnership in defending a High Court claim for misrepresentation and misleading and deceptive conduct under the Fair Trading Act.
  • Creditors and liquidators in numerous voidable transaction claims and advising on complex issues arising under the Personal Property Securities Act and the Companies Act.
  • A vineyard in relation to water rights and proceedings under the Resource Management Act.
  • A national equipment finance company on debt and security issues.
  • A food manufacturer and exporter in litigation involving product liability and supply issues.
  • Homeowners, designers and project managers in construction and leaky building mediations and litigation.
  • A national retail chain in relation to Advertising Standards Authority complaints.
  • A mortgage lending financier in High Court proceedings involving a claim against a firm for professional negligence. 
  • A civil engineering firm in an adjudication proceedings under the Construction Contracts Act.
  • Trustees of a private trust in relation to trustees’ duties and obligations to beneficiaries.
  • A Charitable Trust in High Court proceedings seeking orders under the Charitable Trusts Act.
Caroline has both a Bachelor of Law and Bachelor of Arts degree from the University of Auckland.  Caroline is a member of RITANZ, the New Zealand Credit and Finance Institute, the Property Law Section of the New Zealand Law Society, and the Medico Legal Society.
